Mandatory Arbitration & Class Action Waiver

i. Initiation of Mandatory Arbitration
To resolve disputes, either party may initiate binding arbitration, subject to the conditions outlined below. Specifically, all disputes arising from or related to these Terms (including their formation, execution, or breach), mutual interactions, and/or your use of Health Mife Services will be resolved through binding arbitration conducted by the Judicial Arbitration and Mediation Services (“JAMS”) or its successor, in accordance with the provisions of its Expedited Arbitration Rules and Procedures or Comprehensive Arbitration Rules and Procedures, specifically excluding any rules or procedures governing or permitting class actions.
To start an arbitration process, you must send a letter requesting arbitration and describing your claim to our designated representative. Details of our representative can be found in the “Contact Us” section of our website.
ii. Notification of Disputes
Before proceeding to arbitration, the party raising the dispute must first inform the other party. Send your notice to: [Your Company’s Legal Address]. This notice should include a summary of the dispute, a proposed resolution, and relevant contact information, allowing our team to reach out to you.
iii. Additional Provisions
Your costs for arbitration and your share of the arbitrator’s fees will be governed by the JAMS Comprehensive Arbitration Rules and Procedures and, where applicable, the Consumer Minimum Standards, including the current cap on arbitration service fees. The arbitration session will occur in your county of residence or employment in the United States, another mutually agreed location, or via telephone or online platforms.
The arbitrator will issue a decision within the timeframe set in the JAMS rules. Any court with appropriate jurisdiction may enforce the arbitration award. The arbitrator can award only declaratory or injunctive relief for the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim.
iv. Class Action Waiver
Both parties agree that any dispute resolution will be conducted on an individual basis only, not in a class, consolidated, or representative action. If a claim proceeds to court instead of arbitration, both parties waive any right to a jury trial.
v. Exceptions to Arbitration
Both parties maintain the right to file a lawsuit specifically for injunctive relief to stop unauthorized use or abuse of Health Mife Services or intellectual property infringements, bypassing the initial steps of arbitration or the informal dispute resolution process described.
